This website is operated by Fundora Solutions LLC, a Texas limited liability company doing business as Fundora Consulting ("Fundora," "we," "us," or "our"). We provide digital infrastructure and marketing systems for service businesses across West Texas and the Southwest.
Fundora Solutions LLC is member-managed by Diego Escalante and Julio Balli. This Privacy Policy explains how we collect, use, store, disclose, and protect your personal information when you visit our website at www.fundorasolutions.com (the "Site") or engage with our Services.

We collect only the information necessary to respond to your inquiry and evaluate whether our Services are a fit for your business. We do not collect information beyond what is described below.
Booking & Inquiry Forms
When you submit a form on our Site, the information you enter — such as your name, email address, phone number, business name, and any additional details — is captured and processed through our CRM and form infrastructure platform. This data is used solely to respond to your inquiry, assess your business for our Services, and manage client communications.
We do not subscribe you to any mailing list. We do not send unsolicited marketing emails. If we contact you, it is a direct response to your submission or related to an active engagement.
Messaging & Communications
If you contact us via messaging or communication links on this Site, your message content is transmitted through third-party communication platforms. We use these channels exclusively for direct communication regarding your inquiry or active engagement. Each platform's data practices are governed by its own privacy policy.
Analytics

Fundora operates an interconnected stack of software tools, platforms, and automated workflows to deliver its Services. These systems may collect, process, transmit, or store data generated through your engagement with us — including form submissions, communication records, and operational data — as a normal function of service delivery.
Automated processes may include CRM workflows, email and SMS sequences, booking flows, lead routing, reporting pipelines, and other system-level operations. By engaging with Fundora Solutions, you acknowledge that data processing occurs through automated systems, not exclusively through manual human handling.
Fundora Solutions is not liable for data events that occur as a result of automated system behavior, integration failures, platform-level changes, or third-party processing actions outside our direct control.
4. Data Flow & System Architecture
Your data does not live in a single system. Depending on your interaction with Fundora Solutions, information may flow across multiple platforms including CRM and workflow automation systems, cloud hosting and content delivery networks, communication platforms, analytics providers, and AI or automation tools used in service delivery.
Each platform in our stack handles data in accordance with its own privacy policies and security standards. Fundora Solutions configures these systems to our operational requirements but does not own, operate, or control the underlying infrastructure. We are not responsible for how third-party platforms process, store, or transmit data once it enters their systems.
5. AI-Assisted Processing
Fundora Solutions uses artificial intelligence tools and AI-assisted workflows in the delivery of Services. This may include content generation, data analysis, automated communication drafting, and process automation. Where AI tools process information — including information related to your business or engagement — that processing is governed by the privacy policies of the respective AI platform providers.
We do not share sensitive personal information with AI platforms beyond what is operationally necessary. All AI-generated outputs are reviewed by our team before delivery. Fundora Solutions does not train proprietary AI models on client data.
6. Cookies & Tracking Technologies
This Site does not set first-party cookies. Our analytics provider is cookieless by design. However, third-party services embedded on or connected to this Site — such as CRM forms or third-party resource delivery — may set their own cookies or use similar tracking technologies in accordance with their respective privacy policies. We do not control third-party cookies.

When clients provide Fundora Solutions with access to their platforms, credentials, customer data, or business systems for the purposes of service delivery, the client retains full ownership and responsibility for that data. Fundora Solutions acts as a data processor in those contexts, handling client data solely as directed and within the scope of the applicable service agreement.
Clients are solely responsible for: ensuring they have legal authority to share any data provided to Fundora Solutions; obtaining required consents from their own customers or contacts; complying with applicable privacy laws governing their own data collection practices; and notifying Fundora Solutions promptly if any data shared is subject to regulatory restrictions or breach obligations.
Fundora Solutions shall not be liable for any regulatory, legal, or civil claims arising from a client's own data practices, failure to obtain proper consent, or misrepresentation of data ownership.
9. Data Sharing & Disclosure
We do not sell, rent, or trade your personal information. We may share your information only in the following limited circumstances:
Service providers — We share data with third-party platforms integral
to delivering our Services (such as CRM systems, cloud hosting providers, and
communication platforms). These providers process data on our behalf and are subject to
their own privacy policies and data processing obligations.
Legal compliance — We may disclose information if required by law,
subpoena, court order, or governmental regulation, or if we believe disclosure is
necessary to protect our rights, enforce our Terms, or ensure the safety of our users.
Business transfer — In the event of a merger, acquisition, asset sale,
or reorganization, your information may be transferred as part of that transaction. We
will notify affected parties if their data becomes subject to a different privacy policy.
10. Third-Party Infrastructure & Disclaimer
Our Services run on third-party infrastructure that we do not own or operate. System categories in our stack include:
CRM & Workflow Systems — client relationship management, form capture, booking, and automation.
Hosting & Infrastructure — cloud hosting, DNS, CDN, DDoS protection, and web analytics.
Content Delivery Networks — third-party typeface and resource delivery.
Communication Platforms — direct messaging and contact channels.
AI & Automation Tools — AI platforms used operationally in service delivery.
Fundora Solutions expressly disclaims all responsibility for outages, data loss, security breaches, unauthorized access, policy changes, API changes, or service discontinuation by any third-party provider. We cannot guarantee the security, availability, or data handling practices of any platform outside our direct control. You are encouraged to review each provider's privacy policy directly. Any issues arising from third-party platform behavior must be addressed with that provider.
11. Data Retention & Deletion
We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.
Inquiry data — Form submissions from individuals who do not become
clients are retained for up to twelve (12) months from submission, then deleted from
active systems.
Client data — Information related to active engagements is retained
for the duration of the engagement and for up to twenty-four (24) months following
termination, to support post-engagement obligations, dispute resolution, and legal
compliance.
Analytics data — Our analytics provider retains aggregate, anonymized
traffic data per its own retention schedule. This data contains no personally
identifiable information.
Verified deletion requests from non-clients will be processed within 30 days. For client data, deletion is governed by the applicable service agreement. Fundora Solutions cannot guarantee deletion of data held by third-party platforms — deletion from those systems is governed by each provider's own policies and must be requested directly. Backup and archival systems may retain residual copies for a limited period as part of normal operational processes.
12. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect and process. The Site is served over HTTPS via our hosting provider's global network, and form submissions are transmitted over encrypted connections (TLS).
No method of transmission over the internet or electronic storage is absolutely secure. Fundora Solutions expressly disclaims any warranty or guarantee of security for data transmitted to or stored by us or our third-party service providers. We are not responsible for data security incidents arising from third-party platform vulnerabilities, client-side security failures, credential compromise, or circumstances beyond our reasonable control. Use of our Site and Services is at your own risk with respect to data security.
13. Data Breach Notification
In the event of a confirmed data breach affecting your personal information, we will make reasonable efforts to notify affected individuals in accordance with applicable state and federal laws, including the Texas Identity Theft Enforcement and Protection Act (Tex. Bus. & Com. Code § 521.053).
Notification may be provided by email, postal mail, or conspicuous posting on the Site, depending on circumstances and applicable legal requirements. We do not guarantee any specific timeframe for breach notification beyond what is required by applicable law. Fundora Solutions shall not be liable for unauthorized access or data breaches caused by third-party service providers, criminal acts, or circumstances beyond our reasonable control.
14. Cross-Border Data Transfer
Fundora Solutions is based in the United States. If you access the Site or submit information from outside the United States, your data will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
